1. Acceptance of Terms
By creating an account or using EndorseKit ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Narber Aviation LLC ("Company," "we," "us").
2. Nature of the Service — Record-Keeping Aid Only
EndorseKit is a digital record-keeping and organizational tool designed to assist certificated flight instructors in maintaining endorsement records. THE SERVICE IS NOT LEGAL COUNSEL, REGULATORY ADVICE, OR A SUBSTITUTE FOR PROFESSIONAL JUDGMENT. Ultimate responsibility for compliance with 14 CFR Part 61, including but not limited to FAR 61.189, rests entirely and solely with the individual flight instructor. Narber Aviation LLC makes no representation that use of this Service guarantees regulatory compliance or protects against FAA enforcement action.
3. Refund Policy
Pro subscriptions include a 7-day satisfaction guarantee from the date of purchase. Refund requests submitted within 7 days of the original purchase date will be honored in full. Refund requests submitted after 7 days from the purchase date will not be honored under any circumstances. To request a refund within the eligible window, contact ethan@narberaviation.com with your account email and purchase date. Narber Aviation LLC reserves the right to deny refunds where abuse of the refund policy is suspected.
4. Limitation of Liability — Data Loss
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NARBER AVIATION LLC SHALL NOT BE LIABLE FOR ANY LOSS, CORRUPTION, OR UNAVAILABILITY OF DATA, INCLUDING BUT NOT LIMITED TO ENDORSEMENT RECORDS, STUDENT INFORMATION, OR OUTCOME DATA, ARISING FROM: (a) platform outages or failures by third-party service providers including Supabase, Netlify, or Stripe; (b) user error including accidental deletion of records; (c) cyber attacks, unauthorized access, or security incidents beyond our reasonable control; (d) force majeure events. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING INDEPENDENT BACKUP RECORDS OF ALL ENDORSEMENTS AS REQUIRED BY 14 CFR 61.189. EndorseKit is a supplementary organizational tool and does not replace your obligation to maintain original logbook endorsement records.
5. Limitation of Liability — General
IN NO EVENT SHALL NARBER AVIATION LLC, ITS OWNER, OFFICERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
6. FAA Regulatory Compliance
EndorseKit does not verify, certify, or validate the accuracy of any endorsement text, date, or record entered by the user. The user is solely responsible for ensuring that all endorsements issued comply with applicable FAA regulations including but not limited to 14 CFR Part 61 and the current edition of Advisory Circular 61-65. Narber Aviation LLC is not liable for any FAA enforcement action, certificate action, or legal proceeding arising from inaccurate, incomplete, or non-compliant endorsement records.
7. TSA Security Requirements
For endorsements related to TSA citizenship verification requirements under 49 CFR § 1552.3, the user is solely responsible for verifying and retaining required documentation. EndorseKit provides a field to record document reference numbers as a convenience only. Narber Aviation LLC makes no representation regarding compliance with TSA requirements and is not liable for any TSA enforcement action.
8. Data Privacy & Security
We implement commercially reasonable technical measures to protect your data, including row-level security enforced at the database level. However, no system is completely secure. You acknowledge that you provide data at your own risk. We do not sell your data to third parties. Student records and endorsement data are accessible only to the authenticated account holder. In the event of a data breach that materially affects your data, we will notify you via the email address on file within a reasonable time.
9. Account Termination & Data Retention
Upon cancellation of a Pro subscription, your account reverts to the Starter plan. All existing records remain accessible in read-only format for student records beyond the Starter plan's active student limit. Narber Aviation LLC reserves the right to terminate accounts that violate these Terms. Upon account deletion, your data will be removed from our systems within 30 days, subject to any legal retention obligations.
10. Modifications to the Service & Terms
Narber Aviation LLC reserves the right to modify, suspend, or discontinue the Service at any time with reasonable notice. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email to the address on file.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Polk County, Iowa.
